—Motion for a new trial under section 3001 of the Code, made by defendants, impleaded, etc., executors of George L. Marvin, deceased. The object of the action is to obtain a decree dissolving a copartnership alleged to have existed between said George L. Marvin and Le Grand Marvin, the assignor of the plaintiff’s testator, Simon L. Greenwood, and providing for a disposition of the partner*237ship property and a division of the proceeds thereof.
