Appeal from a judgment of the Supreme Court, Monroe County (Harold L. Galloway, J.), entered September 11, 2009 in *1707a proceeding pursuant to CPLR article 78. The judgment declared that petitioners are not entitled to permanent appointments to the position of investigator pursuant to Civil Service Law § 58 (4) (c) (ii).

It is hereby ordered that the judgment so appealed from is unanimously reversed on the law without costs, the petition is granted and the matter is remitted to Supreme Court, Monroe County, for further proceedings in accordance with the following memorandum: Petitioners commenced…
