In this paternity suit, defendant now appeals from a judgment of The Family Court for the Parish of East Baton Rouge declaring him to be the father of petitioner’s child. Prior to the trial on the merits defendant filed two exceptions, a *83declinatory exception questioning the court’s jurisdiction over the subject matter and one which he entitled “Exception of No Right of Action” contesting the procedural capacity of the plaintiff to institute and maintain the suit itself.
