The plaintiff, then a civil service employee of the United States and a veteran preference eligible under the Veterans’ Preference Act of 1944, 5 U.S.C. § 851 et seq. (1958), was separated from the Government service at the close of April 30, 1959, when his position as medical photographer, GS-Y, at the Veterans Administration Hospital in Little Bock, Arkansas, was abolished. The plaintiff contends that his separation was unlawful, and sues for back pay.
