STATEMENT OF CASE

On November 17, 1994, the grand jury-indicted Derek Landry for the first-degree murder of Lloyd Gonzales, Jr., during the perpetration or attempted perpetration of an armed robbery, a violation of La. R.S. 14:30. Landry was tried by jury, convicted and sentenced to death.

On direct appeal to the Louisiana Supreme Court, Landry’s conviction and sentence were reversed, and the case remanded for new trial on the basis that the appellate record was “so deficient” the Court could not properly review the case. See State v. Landry, 97-0499 (La.6/29/99), 751…
