HAIRE, Judge.

In this special action the petitioning defendant seeks reversal of an order of the Superior Court denying petitioner’s motion for summary judgment based on the statute of limitations.

The civil action filed in the Superior Court sought damages for personal injuries suffered when the respondent-plaintiff allegedly slipped and fell in defendant’s parking lot on August 16, 1969. On August 13, 1971, a complaint alleging a claim against defendant for personal injuries allegedly suffered by plaintiff was filed in the Superior Court.
