On September 2, 1999, this court held a de novo non-jury trial on the record in accordance with Kearney v. Standard Ins. Co., 175 F.3d 1084 (9th Cir.1999) (en banc), petition for cert. filed, 68 U.S.L.W. 3106 (U.S. July 27, 1999). Kenneth Isserlis appeared on behalf of Plaintiff.
