Judgment, Supreme Court, Bronx County (David Stadtmauer, J.), rendered March 12, 2003, convicting defendant, after a jury trial, of attempted robbery in the first degree, and sentencing him to a term of five years, and order, same court and Justice, *358entered on or about November 5, 2003, which denied defendant’s CPL 440.10 motion to vacate the judgment, unanimously affirmed.
