In this proceeding the petitioner seeks to recover from the respondent village the sum of $3,000 upon the ground that the intestate, Edmond H. Smith, being an active member of *686a volunteer fire company in the respondent village, died from injuries incurred while in the performance of his duties as such fireman. Recovery is sought under the provisions of subdivision 1 of section 205 of the General Municipal Law. Jurisdiction to determine the controversy arising under the provisions of that section is conferred thereby upon the county judge of the county. As required by the statute, the…
