ORDER

SAM, Chief Judge.

The petitioner, Joseph Mitchell Parsons, an inmate at the Utah State Prison, filed this action for a writ of habeas corpus under 28 USC § 2254 seeking relief from his conviction in the Utah courts for First Degree Murder and a sentence of death. The case was referred to the magistrate judge under 28 USC § 2254. The magistrate judge made a report and recommendation that the petition for habeas corpus be denied.
