In an action to recover damages for medical malpractice and wrongful death, the defendant appeals from so much of an order of the Supreme *388Court, Rockland County (Weiner, J.), dated August 31, 1995, as granted the plaintiffs cross motion to strike his third affirmative defense and for leave to serve an amended complaint.
Ordered that the order is modified by (1) deleting the provision thereof granting that branch of the plaintiffs cross motion which was to strike the defendant’s third affirmative defense with respect to those claims arising out of medical services provided prior to February 13,…
