Reversing.

The controversy presented on this appeal from a judgment adverse to appellant, rendered in a declaratory judgment proceeding, may be gathered from former opinions of this court. City of Paris v. Kentucky Utilities Co., 280 Ky. 492, 133 S. W. (2d) 559, contains a history of matters out of which this controversy springs, going back to the time in November, 1909, when franchise was granted to the Paris Electric Company, bringing the status down to 1939 when that opinion was rendered.
