HENDRY, Judge.

This is an appeal from a summary final judgment and a cost judgment, entered by the court below, in favor of the defendant-appellee.

The appellant-plaintiff filed a complaint against the defendant in which it was alleged that the plaintiff, an attorney, was retained by the defendant and one George Bringhurst, to represent him in connection with a controversy they were having with Australian National Airways.
