Beauchamp Ciparick, J.) which, inter alia, denied that portion of defendant’s motion pursuant to CPLR 3211 (a) (7) to dismiss the first cause of action of the plaintiff’s complaint, unanimously reversed, insofar as appealed from, without costs, the defendant’s motion is granted and the first cause of action of the plaintiff’s complaint is dismissed.
