This was an action of debt, brought by appellee, in the Superior Court of Cook county, against appellant. The declaration contained two counts the first, for double rent on the demised premises for two and a half months. It is averred appellant held over after he had forfeited his lease, and after notice to quit. The second count is for use and occupation. A trial was had by the court without a jury, by consent of the parties, when the court found for, and rendered judgment in favor of plaintiff, at the rate of double the yearly value of the premises.
