|2In this criminal proceeding, Cesar A. Lobo, defendant/appellant, appeals his sexual battery conviction and his eight-year hard labor sentence 1 imposed without benefit of parole, probation, or suspension of sentence. The state originally charged Mr. Lobo by bill of information with simple rape, in violation of La.R.S. 14:43. A few months before trial, the state amended the bill of information to sexual battery, La.R.S. 14:43.1, a lesser charge.
