Appellant, who was a candidate for the office of prosecuting attorney, filed a petition to contest the election for that office under section 29-2304, Burns’ Ann. St. 1933. His petition is upon the ground of illegal votes and fraud or mistake in the official count. The petition states that the contestor desires a recount of the votes.
