MEMORANDUM AND ORDER

SAFFELS, District Judge.

Petitioner has filed with the clerk of the court this petition for writ of habeas corpus pursuant to 28 U.S.C. § 2254 seeking release on bail pending appeal to the Kansas Supreme Court of his state court conviction for unlawful possession of a firearm. After being sentenced to a three-to-ten-year term of imprisonment, petitioner filed a timely notice of appeal and made a motion in the state trial court for bail pending appeal, which motion was denied.
