This was an action brought by William Jackson, plaintiff below, against the Missouri, Kansas and Texas Railway Company of Texas, defendant below, to recover damages for personal injuries alleged to have been received by him through the negligence of the defendant while working in a sand pit under one Homer Wright, who was defendant’s vice-principal, and in which action judgment was rendered for the defendant.
