The record in this case shows that on November 12,1897, in vacation, the appellant filed with the clerk of the Circuit Court of DeWitt County, a declaration in assumpsit, in which he charged that appellee made and delivered to Scroggin & Company his promissory note, dated August 9, 1895, in which he promised to pay them, one year after date, $543.75, with interest at the rate of seven per cent per annum from date until paid, to which was. also added a power of attorney authorizing any attorney to confess judgment in any court at any time thereafter for the amount that appeared to be due and…
