Per Curiam. —

The record in this case shows that the Citizens State Bank for many years past has conducted a general banking business at Marianna, Florida. It was capitalized at $30,000.00, and during the year 1925, or 1926, the State Comptroller raised the question of its solvency and called a meeting of the directors and insisted that its capital structure be repaired. He considered an assessment against the stockholders, and E. N. Horne, D. A. Mc-Kinnon, R. H. Adams, W. S. Brandon, and L. G. Phillips, stockholders and directors of the bank, paid into the bank the aggregate sum of $6,000.00.…
