EAGER, Judge.

Defendant, Lillie Dill, was indicted in the Gity of St. Louis for the first degree murder of Alonzo Small on September 7, 1953. She was found guilty of manslaughter and sentenced to ten years in the penitentiary. Motion for new trial was filed and overruled. The case has been briefed here by both parties. t
