On April 21, 1896, an action was commenced in the district court for the county of Canyon for the purpose ■of testing the legality of the municipal corporation known as the city of Caldwell as a city of the second class, under the provisions of the laws of Idaho. (Idaho 2d Sess. Laws, p. 97.)
