— Reversing.

Under a warrant issued August 26, 1919, by a justice of tbe peace of Fayette county, Clarence Elliott was arrested and charged witb tbe offense of grand larceny. On tbe back of tbe warrant appears this endorsement: “Commonwealth v. Clarence Elliott. 'Warrant. Held to grand jury. ¿Bond $500.”

August 29tk a bond was executed before tbe clerk of tbe Fayette circuit court for the sum aforesaid, witb appellant as surety, tbe undertaking of said bond being that Elliott would appear before tbe Fayette circuit court on tbe 29th of September, 1919, to answer…
