Following the death of Charles L. Stringer, deceased, his widow, Bertie M. Stringer, petitioned the court on December 4, 1957, for the appointment of an adminis*510trator of his estate alleging that he had died intestate. The following day, one Wilhemine M. L. Miller filed a petition containing two causes of action.
