The plaintiff was a regular passenger in the caboose of one of the freight trains of the defendant company. The train stopped to pick up a car which stood on a spur track ahead. The front part of the train, consisting of 18 loaded cars, went forward, leaving the caboose and five cars, also loaded, standing on the main track. After going into the spur, which was some 250 to 300 feet ahead, the train backed down upon the standing cars to couple to them.
