The appellant stands convicted of the crime of murder of the first degree under an indictment charging him with the killing, on July 21, 1920, of Samuel Lucchino, a detective of the City of Pittstón. The deceased was shot from the rear by one lying in wait. After falling to the ground, a short interval of time intervening, he was shot a second time. Death did not follow immediately, but Lucchino was rendered speechless, though apparently retaining consciousness, until his removal to the hospital, where he died, some forty minutes after the assault.
