Respondent/cross-appellant Mark Markiewicz was a police officer employed by the City of Reno. In 1996, Congress amended the Gun Control Act of 19681 to add certain provisions relating to domestic violence, and made it illegal for persons convicted of domestic violence misdemeanors to carry firearms.2 Markiewicz *857had been convicted of a domestic violence misdemeanor, and the City informed him that, consequently, he would be discharged.
