This was a bill of review, filed by the defendant in error, in the probate court of Wilkinson county.

The bill alleges, that at May term, 1847, of that court, the plaintiff in error preferred a claim against Lorenzo D. Brown, the defendant’s intestate, for the sum of $26,656.13, with interest, representing by petition that the claim had been presented to the commissioners appointed to audit claims against the estate, which had been duly declared insolvent, and had been disallowed, and praying that the claim should be submitted to referees…
