Plaintiff brought an action against the defendant for malicious prosecution. The defendant in his answer pleaded a general denial. A verdict was returned against the defendant and he has appealed.

Plaintiff and her husband, prior to the bringing of this action, had been employed by the defendant on his farm. As a part of the compensation to plaintiff’s husband it was agreed that the family was to receive the necessary milk and cream for their table use.
