OPINION OF THE COURT

Memorandum.

The order of the Appellate Division should be reversed, and the case remitted to that court for further consideration in accordance with this memorandum.

One of the substantive issues tendered for consideration on this appeal is whether it was proper to permit the prosecutor on cross-examination to impeach an eyewitness to defendant’s arrest, called by the defense, for failure to report to law enforcement authorities or the office of the District Attorney exculpatory information to which he testified on trial.
