In this compulsory accounting proceeding the respondent executor having challenged the status of petitioner, a preliminary hearing was had to determine petitioner’s status as a claimant or creditor of decedent.

The proof of claim alleges that claimant rendered personal services for decedent over a period of 25 years; that on numerous occasions decedent promised to compensate, claimant by an appropriate legacy in his will, on the strength of which claimant continued to render services of the reasonable value of $20,000.
