This was an action by Key and Bailey, the appellants, against Ostrander, to recover the possession of a tract of land, which is described in the complaint as “forty *2acres, in the north-east quarter of section thirty-six (36), north of Otter Greek, in township thirteen (13) north, of range nine (9) west, in Vigo county, -Indiana.” '
The defendant answered by the general denial, and also by a special paragraph, on which issue was taken, but which need not be noticed further, as all matters of defense were admissible under the general denial.
