FOR THE COURT:

¶ 1. This is an appeal from Jefferson Davis County Circuit Court of the dismissal of DeMario Walker’s motidn for post-conviction relief (PCR) filed after his probation was revoked and he was sentenced to serve the full five years’ incarceration of his suspended sentence for his first technical violation. We affirm in part and reverse and remand in part for further consideration consistent with the provisions of Mississippi Code Annotated section 47-7-37 (Supp. 2016) and this opinion.
