This is one of the earliest cases in which a federal district court has been called upon to interpret the meaning of the Comprehensive Environmental Response, Compensation, and Liability Act (“CERCLA” or “the Act”). On the present motion, the Court must determine the extent, if any, to which CERCLA provides for a private cause of action.
