This bankruptcy case was filed in July 2004, and on December 17, 2004, Saunders Real Estate Corporation (“Saunders”), filed a Complaint under Section 727(a)(3) of the Bankruptcy Code, seeking denial of discharge, on the ground that Marc J. Pearlman (the “Debtor”) failed to maintain books and records from which his financial condition might be ascertained.
