CLARK and MONTGOMERY, JJ., dissenting. The prisoners are indicted for the (734) murder of Thomas Stevenson; found guilty of murder in the first degree, and are now under sentence of death. The evidence discloses the following facts:
C. T. Peele is a merchant in Bertie County, and on the morning of 9 April Joe Peele left an order at his store to let Jim Stevenson have twenty pounds of meat and a sack of meal; that evening about 4 or 5 o'clock Peele's wagon drove up to the store with the prisoners in it.
