1Opinion of the Court

By the Court.

An action was instituted in the Court of Common Pleas to enjoin proceedings to assess, certify and collect taxes against an estate. That court granted a permanent injunction against the county auditor after trial upon the pleadings, evidence, briefs and argument of counsel. A motion for new trial was overruled, whereupon the defendants filed a notice of appeal to the Court of Appeals on questions of law and fact and gave an appeal bond. A bill of exceptions was duly filed in and allowed by the Court of Common Pleas and was thereafter duly filed in the Court of Appeals.
