This appeal is a consolidation of two cases involving the same

defendant and occurrence. A late notice of appeal from the order of November 2, 1983, in case No. 82 CM 4142 — 01, was allowed by this court on February 16, 1984, over objection by defendant. The State appeals from the trial court’s order of November 2, 1983, granting defendant’s motion for a finding of not guilty based on lack of evidence. The State also appeals from the trial court’s order of January 4, 1984, in case No. 83 OF 1686, granting defendant’s motion to dismiss on the sole ground that it was improper for one trial court…
