The plaintiff’s complaint alleges : “ That on the seventh day of August, 1892, the * * plaintiff was a passenger on one of the defendant’s trains from Albany to Lyons, Wayne county, New York ; that, upon the arrival of the said train at Lyons station, plaintiff got off at the usual and customary place for passengers to leave said train, in order to get therefrom to the depot; that thereupon said plaintiff proceeded to go by the usual and customary route from said train to said depot, and in so going was necessarily obliged to cross one track and through and under the coal chute of…
