This was an action brought by George W. Newman in the district court of Lyon county, against the city of Emporia, a city of the second class, and William Ernst, county treasurer of said county, to restrain them from collecting a certain special tax or assessment levied upon certain real estate of the plaintiff in said city for macadamizing a portion of Sixth avenue in said city.
