In this proceeding-it is sought by mandamus to compel the respondent to enter an order granting the motion made by relator’s counsel to strike a cause in which relator was respondent, from the calendar.
The relator was bound over to the circuit court February 26,1918, on the charge of retailing liquor without a license. The recognizance called upon him to appear at the present term of the circuit court February 26, 1918, the then February term of the circuit court having commenced February 4, 1918.
