THIS CAUSE came before the Court for Final Hearing February 11, 1991, with Defendant and a representative of Plaintiff present and both parties well represented by counsel. Based on the evidence presented the Court makes the following findings of fact and conclusions of law:

1. Plaintiff, as landlord, and Defendant, as tenant, entered into a written month to month tenancy (“Lease”) effective February 28,1990, *209for $183.00 per month. Plaintiff received rental subsidies directly from H.U.D. for the tenancy.
