This proceeding was instituted in view of the determination of the Court of Appeals in Hogan v. Kavanaugh, 138 N. Y. 417.

Edward Howard died in the month of September, 1864, leaving a widow, one son and three daughters. His will, bearing date March 24, 1864, with a codicil thereto-, dated April 21st of' the same year, was admitted to probate January 25, 1865.
