LURTON, Circuit Judge.
This is an appeal from an order of the District Court, sitting in bankruptcy, disallowing a mortgage lien claimed by the First National Bank of Canton, Ohio, upon a stock of merchandise and certain store fixtures of the bankrupt, Martin K. Purdy. The mortgage in question was made on December 5, 1903, and registered December 8, 1903. The mortgagor was adjudicated a bankrupt on February 4, 1904. The mortgage purports to have been made to secure a present loan of $739.93, for which the bankrupt gave four notes, maturing, respectively, in 30, 60, 90, and 120 days from date.…
