In September of 1955, defendant entered into a collective bargaining agreement with Local 49 of the International Union, United Automobile, Aircraft and Agricultural Implement Workers of America. In December of 1957, a large number of defendant’s employees together with plaintiff were laid off, allegedly due to a breach by defendant of certain "transfer of work” clauses in the agreement. On March 10, 1958, Claude Wilson, plaintiff Ball, and Rupert Fitzgerald brought suit in their own right and as assignees of 26 other laid-off employees against defendant.
