This is an action brought to recover rent under a written lease bearing date March 22, 1920, for an apartment in the premises 176 West Eighty-seventh street, in the borough of Manhattan, city of New York, and the question involved is whether the lease was entered into on April 1,1920, as claimed by the tenant, or on March 31, 1920, as claimed by the landlord. If the contention of the landlord is correct, then the defendant is concededly not in a position to avail himself of the provisions of chapter 136 of the Laws of 1920 (being one of the April Rent Laws of 1920), by interposing…
