delivered the opinion of the court:

Plaintiff in error, Waiter Scott, alias Frank McErlane, was jointly indicted with James Perry and Robert Webb for robbery. Scott wa§ tried alone by a jury in the criminal court of Cook county. He was found guilty as charged, and in addition to the general verdict of guilty the jury . found that at the time of the commission of said robbery defendant was apmed with a revolver, with intent, if resisted, to then and there kill or maim the person so robbed.
