TUTTLE, District Judge.

This cause is before the court on two petitions filed herein by the Ford Motor Company, hereinafter referred *340to as the petitioner; one being a petition to review an order of one of the referees in bankruptcy in certain summary proceedings hereinafter mentioned, and the other being a petition praying' leave to join the trustee in bankruptcy herein as a party defendant in a certain suit instituted by said petitioner in one of the state courts of Michigan. The material facts involved are undisputed and are as follows:
