This claim arises out of an accident that occurred on January 21, 1994 at approximately 10:30 a.m. on Route 22, approximately one mile north of Route 202 in Westchester County. Ann Marie Culhane (hereinafter claimant)1 was driving her car southbound on Route 22, when New York State Trooper John R. Ebanks accelerated his Trooper car, activated its emergency lights, and proceeded from the northbound lane into the southbound lane, hitting claimant’s car.
